Terms and Conditions (T&C) and Right of Withdrawal

§ 1 Scope

These Terms and Conditions apply to all contracts concluded via the online shop between the provider and customers. This includes the sale of both physical and digital products.

§ 2 Contracting Party

The contracting party of the customer is Mariam Hardjowirogo, operator of the online shop.

§ 3 Conclusion of Contract

1. The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
2. By submitting an order, the customer makes a binding offer to purchase. The provider confirms receipt of the order by email. The contract is concluded upon this confirmation.
3. For digital products, the contract is concluded when the download link is provided after payment.

§ 4 Prices and Small Business Status

1. All prices are final. Due to small business status according to § 19 UStG, VAT is not displayed.
2. The provider reserves the right to change prices at any time. Confirmed orders remain unaffected.

§ 5 Payment Terms

Payment can be made via PayPal, credit card, or other payment methods offered in the online shop. The provider reserves the right to exclude certain payment methods.

§ 6 Shipping and Delivery

1. Shipping is available within Germany, Europe, and internationally.
2. All physical products are shipped insured with tracking. Delivery to parcel lockers is excluded.
3. Shipping costs are displayed during the checkout process.
4. Delivery times: approx. 3–5 business days within Germany, 7–14 business days within Europe, and 14–30 business days internationally.
5. The provider is not liable for delays due to customs clearance or international shipping issues.

§ 7 Right of Withdrawal

1. Consumers have the right to return the goods within 14 days without stating a reason.
2. The withdrawal period begins upon receipt of the goods. Timely dispatch is sufficient to meet the deadline.
3. Returns must be insured and include tracking. The customer bears return shipping costs unless the item is defective.
4. Refunds cover the purchase price and standard shipping costs but not additional shipping options such as express delivery.
5. Exclusions: Digital products cannot be returned once the download has been provided. Custom-made items are also excluded from the right of withdrawal.

§ 8 Digital Products

1. The customer receives a simple, non-transferable right to use digital products for personal purposes only. Commercial use or redistribution is prohibited.
2. The right of withdrawal is waived once the customer starts the download.
3. The customer is responsible for ensuring technical compatibility.

§ 9 Customer Account and Registration

1. Customers can optionally create an account to track orders and review products.
2. The customer must keep their login credentials secure and not share them with third parties.
3. The provider reserves the right to suspend or delete accounts in case of misuse.

§ 10 Warranty and Liability

1. The statutory warranty provisions apply. Customers must report obvious defects within 7 days of receiving the goods.
2. The provider is not liable for improper handling or misuse of the products.
3. Color deviations between product images and actual goods do not constitute a defect.
4. The provider is not liable for delays or losses during international shipping.

§ 11 Custom Orders

1. Small deviations from the original design may occur in custom orders.
2. Custom-made items cannot be returned unless they have significant defects.
3. The customer is informed about details and production times before ordering.

§ 12 Care Instructions

1. Dolls should be kept away from direct sunlight and stored in a dry environment.
2. Only mild cleaning agents should be used for cleaning.

§ 13 Age Restrictions and Use

1. Unless otherwise specified, the dolls are collector's items and not suitable for children under 14 years.
2. The provider is not liable for damages caused by improper use.

§ 14 Retention of Title

1. The goods remain the property of the provider until full payment is received.
2. If a payment is reversed, the provider reserves the right to reclaim the goods.

§ 15 Final Provisions

1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
2. If any provisions of these T&C are invalid, the remaining provisions remain unaffected.
